Michael V. Madden wins summary judgment on behalf of local police department
Madden & Madden Partner, Michael V. Madden, successfully obtained summary judgment on behalf of a local Police Department and one of its officers pursuant to an Order issued on March 5, 2021 by The Honorable Yolanda C. Rodriguez, Judge for the Superior Court of New Jersey. In this matter, plaintiff was allegedly injured during a motor vehicle accident with the officer as the officer was responding to an emergency call. Judge Rodriguez found that the Defendants were entitled to qualified immunity under the New Jersey Tort Claims Act since the officer’s actions were conducted in good faith in the execution or enforcement of the law. Judge Rodriguez further found that the officer’s actions were not reckless or committed with willful misconduct. In addition, Judge Rodriguez found that plaintiff failed to maintain the mandatory minimum medical benefits coverage and therefore was barred from economic and non-economic recovery under New Jersey law.
